Spencer Elden, the man who, as a baby, posed for the iconic cover image to Nirvana’s Nevermind is reportedly suing the band and Kurt Cobain’s estate, claiming he was exploited for the picture.

Court documents allege the band “knowingly produced, possessed, and advertised commercial child pornography depicting Spencer, and they knowingly received value in exchange for doing so.”

According to Elden, photographer Kirk Weddle took pictures of his naked body “in poses highlighting and emphasizing Spencer’s exposed genitals.”

The suit further alleges that Cobain “agreed to redact Spencer’s image by releasing the album with a sticker strategically placed over Spencer’s genitals with the text: ‘If you’re offended by this, you must be a closet pedophile.’” Such a sticker was “never incorporated” into the album’s cover.

Interestingly, the suit cites album covers for Scorpion’s Virgin Killer, Blind Faith’s Blind Faith, and Van Halen’s Balance as other examples of previous “controversial campaigns used to promote music with sexually explicit material depicting a child or outright child pornography.”

“Neither Spencer nor his legal guardians ever signed a release authorizing the use of any images of Spencer or of his likeness, and certainly not of commercial child pornography depicting him,” the documents further state.

Elden claims that the image has caused him to “suffer lifelong damages."

Released Sept. 24, 1991, Nevermind would become one of the most legendary albums in rock history. The LP rocketed Nirvana to stardom and became the definitive release of the grunge revolution. Its cover, featuring the naked four-month-old Elden in a swimming pool, being lured by a dollar bill on a fishing line, ranks among the most iconic album covers of all time. According to a 2008 report from NPR, Elden’s father, Rick, was paid $200 for his child’s modeling work.

In adulthood, Elden has recreated the famous cover on multiple occasions. Though he has “Nevermind” tattooed on his chest, Elden’s view of the iconic image has seemingly changed in recent years. In 2016, he admitted to GQ Australia that he was “pissed off” about the picture. “I’ve been going through it my whole life. But recently I’ve been thinking, ‘What if I wasn’t OK with my freaking penis being shown to everybody?,” Elden explained at the time. “I didn’t really have a choice".

  • My Little Pony

Has he suffered "lifelong damages"? Or is he really just "pissed off" because the album's no longer relevant enough to make him popular? I mean he tattooed the fuckin' album title to his chest. Doesn't seem like the actions of a man trying to move past it.

Quick grab for cash in my opinion.

Absolutely no doubt whatsoever. Racked his brain for a way to make some money in hard times, saw this as a possibility and thought why not give it a crack, nothing more than that.

He's been using that cover his whole life, going into bars and saying to chicks, wanna see me naked, again, and shit like that, he even re shot the cover as an adult to put them side by side to show girls how much he grew, he's a scumbag opportunist.

Apparently he's got Nevermind tattooed across his chest. He also happens to be an 'artist' and has retaken that cover shot lots of times to celebrate the anniversary of the album's release.

Definitely a cash grab. What a tool!

The funniest part about the entire thing (and for fuxx sake there are numerous wtf funny things here) is there is not 1 living or dead being that would have ever placed this dude as the baby, UNLESS HE BEGGED FOR THEM TO "PLEASE BELEIVE ME IT ME (ME ME ME)!!!"

    • Well this is some excellent news. Going to see Sophie Lloyds first headline show on 17th Oct in London (tiny club called The Underworld) and it has just been announced that the support act will be Chez Kane... can I handle two fit birds peforming on stage or will my heart give out before the show is over?
    • I don't rate or grade albums with any kinda numbering system or percentage. All I do is think which were the albums I enjoyed most, which generally means got played the most (I mean you don't play the worst albums over and over again for months), with memorable songs. Then when it comes to what order they go in. Once again, I just go with what I feel got the most airplay for me over the course of time. Obviously an album released in Jan is gonna potentially have more play time than one released in November, but It's down to longevity as well. If I play an album solidly for a month then move on, it's probably gonna be top 10, but if other albums are still being played regularly 3 or more months after release, those are gonna rank higher. I mean this year Judas Priest was a fairly early release in the year, but I am still playing it now, although  not as often. Then an album like Mick Mars which I loved, but has kinda fallen off my radar in the last six months, will rank a lot lower. I try to not go for recency bias as well even though I have been listening to one album in my top 10 for only a week, but it was such an insantaneous album I know its gonna get heavy play time for the next few months.
    • Good Times Roll-The Cars
    • Video for 'I'll Stand For You'.
    • New song 'Who Am I' taken from the album 'Into The Great Unknown' out November 15 through Frontiers.
    • @Darkstone, I just randomly clicked on your link and listened to "Hardened Heart." In the interest of full disclosure, I am not personally a fan of AI music--I find something about the vocals sterile and offputting--but I wanted to say that I thought that particular song sounded like something White Lion would have done back in the day. Nice power ballad, despite my aforementioned issues with AI tunes. While it's not for me, I'm glad people have an outlet for their creative impulses, and there's no doubt some cool stuff is emerging, with "Hardened Heart" being among the best I've heard.
    • Isn't that like the Hawaii situation all over again? But at least the Ukraine have all the US-funded weapons they need, I guess.  Anyway, Mike, sounds really full on but I am glad that you and your family are well, relatively speaking. Wishing you and all the surrounding communities a worthy recovery.
    • Quite sad, my band probably would have shared a stage with these guys in December...
    • That new sound is great...a new singer too by the looks of it...loving that
    • Glad to hear that you and your family are safe Whiplash ,just sounds so terrible what you are all going through,my thoughts are with you.
