Hi!

My name is Ken Ortiz.

AKA Kenny Michaels

Here I go again.....defending myself.

 

Please don't buy the Departure Debut CD.

You can probably download it for free somewhere.

Then donate that money to a good cause instead.

A lot of people have been marginalized, abused, and ripped off by this Mike Walsh.

Especially me...Ken Ortiz.

I've tried to reason with this Mike Walsh.

But to no avail.

I've tried to move on.

Also....to no avail.

 

I will never promote it.That Departure CD ESMO28.

Or even sing those songs in the format in which they promote....Ever !

That's not a slight to anyone.

After all the BS.

It's just not in my heart to do so.I thought I could finally move on.

Apparantly not.

Read my Story on Melodicrock.com and the Muzic Forums titled "Departure Fiasco" and check out the despicable lies on You Tube under the "All So Easy" and "The Way You Show Your Love" cut.

Oh and yes I do expect more lies, abuse and name calling from certain Mike Walsh clan members. They will call me or infer that; I'm everything from a murderer to a scumbag to an ungrateful child. Just to name a few.

 

Yet somehow...while being all these horrible things. They found a use for me for years,and forget all the hard work I put into those songs. As well as the turmoil and sacrifice, to write and sing such personal stuff like that.

It all ended up being, unrewarded.

Originally, I got credit in text only.

Now supposedly I did not even write the Bitter Rage ?....LOL.

Sad but true...I just wanted them to come to some fair arbitration.

Even Today...I say make me some offer and stop the name calling.

For it's just a smoke screen.

They would rather attack... verbally bait me.

So when I respond.

They become the victim's and claim I owe them the world and they are so hurt.

As a result they can do or say anything they want.

So... they end up acting like contestant's on the Jerry Springer Show.

I wish them no ill will but they claim ,I will not let go of the past.

What !....WTF !

 

It's been well over a year since I've had anything to say to anyone regarding this issue.

Why was I able to move on ?

Because Escape Music Ltd. deleted it from their files.(thank you).

And NEH records removed it from their roster.(once again,thank you).

That's all I wanted.

As a result;I thought all was quiet on the western front.

Even with their continued clandestine sales on e-bay and several obscure european and asian websites.(Big deal).

Yet when it looks like things are quieting down.

Where maybe we can all move on.

They stir it up again and attack first!

On myspace....then on youtube.

Is this some lame marketing ploy ?

Go figure.

I thought I put this issue behind me.

If they are not going to ever resolve it.

Then so be it.

Don't throw salt in and old wound then claim you are the victims.

While continuing to sell the cd in question, outside of escape and neh.

And I won't move on ?

Pfffft !

I have moved on.

I have gone solo.

I have no delusions predicated on my ego.

I have forgiven them for their greed.

But I must not forget the lesson's learned.

 

Dear Mr. Khalil Turk of Escape Music Ltd.

You have no idea what you have put me through with these people.

I respectfully submit that you created a monster with this Departure Fiasco.

I am to the point where I do not give a shite what is said or thought about me.

For I have survived worse.

And know for a fact...that I am a good person.

Despite the lies.

Despite the inuendos about my mental health.

My so-called ungratefullness.

Yes sir Mr. Turk. I still have the original e-mail where you claim I have a personality complex....When I brought to your attention, my displeasure over how Mike duped me.

It's very sad how things have turned out.

 

For those who don't know me....

I thought I should respond one last time, and clear the air.

So to speak.

And I sincerely include the Mike Walsh clan and Escape Music ltd. in that regard.

So the way i read this , someone (M Walsh or K Turk) asked you to do the vocals on some tracks. How does this make you the copyright holder?

 

Aren't you inferring by saying this that they are not your tracks, but you are doing guest vocals for them?

 

 

DId you write the songs and the music? Or did they. I can't understand you you can claim they are yours if they simply asked you do do some vocals on some pre-exisitng tracks (which is how i read you post). Or were they your tracks from previous sessions with M Walsh?

I bought that album when it came out back in the day....good album!

 

Escape was putting out some killer stuff back then.

 

 

 

 

 

I think it's great you enjoyed it.

There are a lot of great musicians on it.

I thought Mike and Bobby did a fantastic job salvaging those old tracks from the shelf.

Then turning it into a cd.

But unfortunately that was not the issue.

I got so disgusted with the politics and the pretentious crap involved with Escape and Mike that I have never appreciated the roster of music Escape put out.

Maybe I'll check it out someday.

Something is lost in the shuffle here.

Bare with me.

The issue with singing on some old tracks, and being compensated as a performer,are seperate issues from the copyright issues.

 

I was trying to establish that not only was I not compensated for my performance as a singer.

I was not compensated for half the songs on that cd.Which I co-wrote on.

Two examples in contrast:

1. "The Bitter Rage" - My song...My Idea....My personal stuff.

Which started with a moving melody I could sing while fleshing out with Lyrics.Establishing hooks and motifs to enhance the lyrical content with a specific arrangement in mind.

But as the Musician, of course Mike should share in the arrangement and his musical inprint(signature on the song). 50/50.

 

2. "Searchin" - Mikes song...Mikes Music.

A complexed and fast moving song.

Which he himself told me presented a lyrical problem.

He presented a musical bed to me (just musical tracks).

So I wrote all lyrics and moving melody in the vocals.

And had input in the arragement....specifically in what I wanted to do with the bridge.

So as a singer/songwriter I should share in the arrangement and the inprint (signature of the song)50/50

He gave me plenty of latitude there.

And he seemed happy with the result just as I was happy with the result in the Bitter Rage.

Although there were a few tense moments....no big deal.

 

So my point is when looking at the cd it always says Walsh /Ortiz on the songs we wrote together.

Yet at least 4 of those songs were my ideas presented to him.

So the Copyright says or should say Ortiz/Walsh.

Where 2 should say Walsh/Hackett/Ortiz.

And the other songs obviously are Walsh/and other Co-Authors.

I was simply trying to establish that I was not compensated for performing as well as residual royalties.

What ever they may be.

This is the dialogeue I should have been able to have with Escape and Walsh years ago.

But to no avail.

Believe me it it gets even more complicated.

Because of Egos and Money.

Consequently the emotional tangent and horrible name calling on both sides.

Not to mention the new ploy where supposedly I had help from his sister writing a very personal song that she had nothing to do with.

Especially since it was a combination of two songs I wrote. Whereas I created a very melodic and somber hybrid. The Bitter Rage ... "Diamond In The Rough" was done in NYC and performed with a group called METROPOLIS back in 1983.

I use to do it at a club on west 72nd st. called TRAX all the time.

Before I met Mike and his band whose ass I kicked in the Battle of the Bands in Sayerville N.J.

Maybe that's why he won't pay me ...who knows.

OK...I'm just trying to add a little levity there at the end.

I finished a modest sounding cd on a modest budge not too long ago.

Just enjoying the ride this time.

No need to try and be a Rock Star.Nuttin wrong with that though.

    • It's so much better to listen to the original, Erik has done some great covers, but this is a miss imo.
    • This made my recommended list for last year. Far removed sound/style wise from the awesome debut album and only one of the original lineup is featured,  but very very good all the same. 
    • This was released last year and pretty good it is.   From Andy Rethmeier's Youtube channel: A long time ago, in a galaxy far, far away ... well not quite that far away, Hartlepool in County Durham to be precise, a band of rare quality was formed. That band was called White Spirit and after their debut single, "Backs To The Grind" was released on the legendary Neat Records in 1980, the major labels came knocking. They were eager to snap up a band that had far more to offer than the majority of NWOBHM bands that they were lazily bracketed with. MCA Records won the race to sign White Spirit and with a line-up of Phil Brady, Graeme Crallan, Janick Gers, Malcolm Pearson and Bruce Ruff, their self-titled debut album was released later in 1980 to great acclaim. A constant schedule of touring saw the band build up a large and loyal following, but changes in personnel saw Janick Gers join Ian Gillan, to be replaced by Mick Tucker. Toby Sadler took over bass duties from Phil Brady and Bruce Ruff made way for an unknown singer, called Brian Howe. The new and improved White Spirit entered the studio to work on their second album with then Gillan keysman Colin Towns at the production helm. Alas, the album was never completed, the band broke up and musicians went their separate ways. Mick Tucker joined Tank, later followed by Graeme Crallan. Sadler slid easily into Airrace. Mal Pearson stepped away from music for a spell before returning to action with legends The Sweet. Singer Brian Howe crossed the Atlantic and became frontman for Ted Nugent, before achieving mega platinum success as the replacement for Paul Rodgers in Bad Company. So White Spirit were seemingly consigned to music history, with former members proceeding to forge impressive careers built on this promising foundation.  Four decades on and the location of these 2nd album sessions remained a mystery. Presumed to have been consigned to a skip, as was the fate of so many priceless mastertapes carelessly discarded over the years. The day following Brian Howe’s tragic death from a heart attack in May 2020, Tucker and Pearson were on the phone reflecting on those heady White Spirit days. The missing tapes were once more discussed, but still neither had any idea where to find them. Fate stepped in, and whilst preparing to relocate to France, Mal Pearson was rifling through his furniture in storage when he found a dusty old bedside cabinet. Inside were four sets of tapes. One labelled Chiswick Studios – White Spirit. This was it. The one they’d all thought was lost for ever. The tape was handed over to Conquest Music boss and Tank guitarist Cliff Evans. He arranged for the delicate and risky process of baking the tapes to preserve and retrieve the old recordings and transfer them to digital. Successful as the process was, the sound quality of some elements of the tracks were just not good enough for today’s ears, so Tucker & Pearson decided to replace all of the musical accompaniment with a stellar line-up of players. Neil Murray (Whitesnake) and Russell Gilbrook (Uriah Heep) made up the rhythm section, with the guitars and keyboards replaced by Mick and Mal.   Tracklisting: 1.
