  2. But your missing my point: *AFTER* your CD-R merchandise is out on the market and is being sold, he should contact you for his fair share? (forget about his right to approve or deny the reissue to begin with!) What if he doesn't like the quality of your reissue? What if he wanted to reissue it himself or through another label?   4. Sam, if you cannot see how utterly twisted this logic is, any further discussion is fruitless. You're implying that as long as whomever owns the legal rights to the material you're "reissuing" doesn't contact you, everything is fine and dandy. In other words, release whatever you want whenever you want, and *IF* anyone complains, then you'll worry about paying people their fair share... as opposed to getting a legal contract in advance from the parties who own the rights. It's somehow THEIR obligation to come find you rather than YOU contacting them to legally reissue material. It's a play on the old adage "it's easier to ask forgiveness than permission" but completely and utterly warped. -Dan

Since Craig Csongrady, who owns the rights to the album and was a performer on the album was never contacted about this "reissue" and isn't getting paid from it, I guess he's one of the "wrong people". So who exactly are the "right people" that are getting paid, other than yourself? I'm getting tired of all the tapdancing, Sam... I've been trying to keep from openly taking sides, but you're making it difficult as hell. -Dan
  6. What? It's either a bootleg or it isn't. It's on the Retrospect label, so according to everything you've been saying here it couldn't possibly be a bootleg. What does "not 100% legit" mean? To me that means "BOOTLEG". You seem to be contradicting yourself at every turn. -Dan

No offense Sam, but it's not a matter of being "right" or "wrong" in anyone's eyes, but a legal matter as to whom the rights revert to upon the termination of the record label as a business entity. I assume that would be specified in the original contract or in the dissolution of the label; i.e., it's possible that the assets of the label (which could include rights to an artist's catalog) were sold off as part of bankruptcy proceedings to another entity. Just because you "don't think it's right" that a label (active or otherwise) retains rights to an album for an extended period, even if they do not opt to exercise those rights and reissue the album, does not give anyone the right to circumvent a contract in place. Now if the rights legally revert back to the band and they then opt to sign with you, then all is well and good... I'm just saying that it's not as simple as it may seem. -Dan

It ultimately does not reflect well on you and your label. To everyone else: 80sMetalCollector intentionally posted this "news release" in the manner in which he did. His hope was to goad people into responding... and you all fell for it. We are all well familiar with the methods and the dynamics surrounding the whole pro- vs. anti-Retrospect debate by now. By responding to delberate provocation on the part of Retrospect Records and its representatives, you're playing into their hands. Better to say nothing than to perpetuate the debate. Remember, there's no such thing as bad publicity... Oh, and 80sMetalCollector: resorting to namecalling in responding to David's reponse doesn't serve your purpose either. Clean it up. -Dan
  10. Why not just empty your paypal account & then fund the purchase with a credit card or bank account? That's what I do. Because PayPal balances currently earn 4.73% interest, far better than my bank account... Also, funding with a bank account offers you no protection, only credit card does. -Dan
  11. This is one of the reasons that I ignore all auctions that do not accept PayPal. If I pay with check, money order, or cash, I have no recourse whatsoever. If I pay with PayPal, I get 45 days to file a dispute if the merchandise doesn't arrive. Now, there's no guarantee that the seller won't simply empty his PayPal account, in which case PayPal won't be able to recover the funds. That's why for any purchase over $50, unless I've bought from the same seller previously, I pay with a credit card rather than PayPal balance. That way, if PayPal can't recover the funds, or for some inane reason decides against me (I've had this happen on SNAD [significantly Not As Described] claims), I can then file a chargeback with my credit card company and PayPal ends up eating it instead of me. It can get a little complicated, since PayPal will not allow you to pay via credit card if you have any funds in your PayPal balance. Solution: Have multiple PayPal accounts. PayPal allows you to have 1 premier account and 1 personal account (back when I signed up they allowed you to have multiple Premier accounts, so I have 2 Premier accounts). When I want to pay via credit card and have a positive account balance, I send all the funds over to my second account, thus zeroing the balance in my main account, then pay for the transaction with a credit card, then I refund the transaction on my secondary account, sending the money back to my main account with nothing lost in PayPal fees. -Dan
  12. If you want to "out" problem Ebay sellers or buyers here for the good of the community, it doesn't have to be limited to CD purchases, let alone genres appropriate to HH. Any information, both good and bad, about Ebay, that helps protect other folks here, is a good thing. -Dan

  17. Just a few notes to the gentleman in Italy: You use shipping times from other European countries as your measuring stick, which is a wrong thing to do. Packages can take 1-2 weeks just inside the U.S.! Remember, the U.S. is several times bigger than all of Europe; if a package is coming from a small town it may take longer to make its way out to international channels. For international transactions you need to wait a minimum of 21 days before inquiring. You are allowed 45 days to do a PayPal chargeback, so there is no reason to be impatient and rush things. Registered mail is actually slower than normal mail, because it is so secure, so it takes even longer. You should always contact the seller before contacting PayPal. Always. Just because something does not get to you in 2-3 weeks, does not mean a seller is trying to rip you off. -Dan

  19. Won't happen though. It's a negative selling point, and if the majority of people don't care whether the disc is pressed or a CD-R, why (as a seller) would you draw attention to that fact? Now that being said, if people inquire about which releases are silver pressed, Retrospect should be (and I believe for the most part has been) forthcoming with that information. I also personally think that if someone buys a CD, receives a CD-R, and is upset about it, the seller should accept a return for a full refund. -Dan
  20. It's not bad... nothing stellar, but for $5.88 it's hard to go wrong. The interview snippets are about as useless as tits on a bull. The song choices, well I can see why most of these were left off the main album, although Space Oddity is a longtime favorite. Not sure why it didn't make the main album. The covers are executed faithfully, almost too faithfully... nothing that sets them apart from the originals. It gets an ultimate shrug from me... -Dan
