  1. Well, the way I interpret the description, I wouldn't have expected the cd to have been in "really good condition" as you say. Then again, I wouldn't expect it to look like it was skipped across a gravel parking lot, either. Does it skip on your cd player? I would contact the seller with your concerns, especially concerning the front insert if it's in rough shape (other than the tab indentations he mentions). Inquire about a possible refund, say around $15.00 & see what the seller comes back with. Good luck!

  2. Don't freak out...when the email address is "usetheyellowbuttom@ebay.com" it simply means that the ebay user who posed the question has chosen to have his email addess hidden. It's ebays way of telling you to respond to the users question by clicking on the yellow button that says "respond now" (or something like that) that's included in the email. That will route your response through ebay's messaging system.

  3. We have that for small parcels, which cost 5.60$, I ship as oversized letters for 2.99$ and you can't get a green sticker like the parcels. I try to keep my shipping as cheap as possible, the 4$ dollars I'm asking barely covers the postage and packaging.  Iremeber when the US dollar was 75 cents to our 1$, I was actually covering my Ebay fees as well with the 4$. Now with the dollar almost at 90 cents, not anymore.  I'm curious to know what the reaction would be if I asked to print each item individually with it's destination?

I wouldn't even pose it as a question...next time you ship your cd's, simply TELL them that you need an individual receipt for each parcel. You may get some dirty looks from the people in line behind you, but who cares. It's all about covering your ass.

  4. The receipt doesn't show any proof of anything other than having paid 2.99$ for shipping and if I ship 6 or 7 cd's than it show 18$ to 21$ in one big clump. It sucks depending on a business (postal services) that have no repercusions if something gets lost or takes forever to arrive.

Next time, ask if they can print you out an itemized receipt showing the destination for each parcel you ship...that's what I do...

  5. I finally got a response from the guy, here it is:

Hey you fucking PUNK. I was informed by a friend as to what you said in Heavy Harmonies about me. So you're trying to make me look bad when I've never received the CD I won from you 17 days ago. That does make you a FUCKING PUNK!  I've won many CDs from Canada and it's never taken 17 days to get here, (and let me remind you again that it's still not here). Refund my money now or I will continue with the Dispute. Believe me PUNK I'll never do business with you again and I'll make sure everyone I know on e-Bay doesn't do business with you either.

    Nice!

Did this "FUCKING PUNK" buy insurance? If not, then his gripe is with the postal service, not you. What an asshole. It's amazing that paypal allows people to file (& win) claims for not receiving product when they haven't purchased insurance. I ALWAYS get a receipt when I mail something...it is at the very least proof that I mailed something to the city, state, & zip where the buyer lives. Of course, I don't know if that would be good enough for the dumbassess at paypal... <_<

  6. Its gonna suck for you when you finally wake up and realise that Sam's business continues to prosper. Apparently (and this is NOT officially coming from the "Retrospect camp" because i do not represent RR - remember?) his sales are increasing day by day. And i don't see crap happening on the "legal" front either. So it seems all attempts to bring him down are fruitless and pointless.  :eviltongue:  :butt:

If you don't want to be associated with the "Retrospect camp", you might want to stop with the insider info. When you keep speaking of sales increasing & legal issues, it puts you spuare in the middle of that camp, whether you like it or not. Just my 2 cents.

  7. Yeah... Cerbus is another. Short term member with 8 posts... all in this thread. You do have to admitt that something is strange about that. Everytime a new Retrospect thread pops up... so do new members. After the thread dies down, we never hear from those members again.

I'm not arguing anything here... just pointing out a few facts. :headbanger:

Maybe I'm just naive, but I don't see anything particularly strange about a "newbie" showing up & posting concerns about this. Isn't it possible that like cerebus, some people have been pointed in this direction by others that knew about the thread? Or maybe someone just "googled" Retrospect Records & found out about it that way? Does everything have to be a conspiracy to bring down Retrospect by people at this board?

  8. I just wanted to thank everyone for their suggestions on how to handle the situation I am in regarding the cd-r`s I paid over $200.00 for by VegasCds. As much as I want to try and get my money back, I am afraid this guy is going to screw my feedback; from what you are all saying.

I have filed a complaint with the postmaster general. It seems as though once he put a stamp on the merchadise, after falsely adverstising the item is a federal offense.

I can`t imagine I am the only person who got taken from this guy. Hopefully, he will have to answer for how he is misleading customers, and will be dealt with so noone else will have to be put in my situation.

I love 80`s rock, metal, glam, sleaze, etc... and when I have some extra money I love to buy music from the era I love the most. I would never mislead anyone, and just want the same respect when I buy on Ebay.

I love this site. I have been turned on to so many bands I never new exisited back in the day. Dan thanks for turning me on to "Mystery" Cheers...Chris :drink:

Did you ask for a refund before you took this route? From what's been said here, it sounds like getting your money back shouldn't be a problem.

  9. Recordjinky and LVKix,  I find it interesting that you defend Sam's return / satisfaction guarantee.  However, I didn't see you guys post in regards to the Sweet Teaze issue?  Is it safe to assume that your OK with that?  How about the Terra CD?  Was it OK to reissue that without permission of the band?  Since the two of you seem to defend Mr. Vegas on just about every other issue, I was wondering your stance on the bootleg allegations.

I did respond to the sweet teaze issue... it was a sad attempt by the competition to bring down Restrospect. I imagine one might have to use such tactics if one can not compete. Just too bad you all don't know the whole story and what one might try to defeat a rival. Enough said.

Actually, that's not nearly enough said...not by a long shot. Since you seem to be privy to the whole story, how about sharing? I would imagine though, that if Sam had an excuse for the Sweet Teaze release, we would have heard about it by now.

  10. why don't you just contact VegasCds and tell him you are not happy with your order and Sam will be more than happy to accept your returns. He has never denied that to anyone, as far as i know.

Thats one thing that most people seem to forget here is that Sam will always accept a return if you are not satisfied with your item(s).

I wasn't aware that Sam had such a liberal return policy. Again, my suggestion with filing the claim was based on the assumption that he wouldn't accept a return of the merchandise in question.

  11. Funny thing...out of all the times I've had to file a claim with paypal, not ONCE have they contacted me for furthur information, whether my case was eventually won or lost. I don't believe they ever actually contact anyone...on the "he said, she said" cases the assholes probably just end up flipping a coin... <_<

  12. Gotta agree with Cap'n here. Claiming nonreceipt after posting here that you have in fact received them is dumb, not to mention unethical as hell. You can claim SNAD ("significantly not as described"), BUT the majority of these claims fail. Make sure that if you file with PayPal under SNAD, that you fully explain the CD-R issue. If your claim gets rejected, follow up with a phone call. I have gotten *much* further in disputes with a phone call to PayPal "fleshing out" the details of the situation.

The other part of this equation that may result in deciding the claim against you is that while CD-Rs are prohibited on Ebay, they are NOT prohibited when the CD-Rs are officially released by the artist. All Sam has to do is say that they are official releases (which some of them are) and it becomes a giant he-said/he-said, and you will most likely lose.

Assuming that you (hopefully) paid with credit card, once PayPal denies your claim, you can file a chargeback with your credit card company. They are much less forgiving than PayPal.

(not taking sides here, just pointing out that in this instance the deck is stacked in favor of the seller; PayPal autodenies most SNAD claims).

    Dan,

Not trying to start anything here, but didn't you suggested the exact same thing recently...

  13. Thats not a good idea, all Sam would have to to is send eBay a link to this topic & he would not be the one suspected of fraud!

I disagree...at no place in his auction (or his site, for that matter) does he mention the fact that his product is pressed on CDR media. This unsuspecting buyer obviously thought he was getting genuine re-issues on silver pressed discs...otherwise he wouldn't have posted his concerns in the first place. What I meant was that he should file the claim if he attempts to return the merchandise for a refund & is refused...this is exactly the sort of problem Sam's misleading auctions lead to. It's just the first time someone from outside our "circle" who won some of his auctions has posted their disapointment with the final product here.
