  1. Do you think contact with your credit car provider would fix something??

    If so, what can they do..???  Now my money is on that cheater´s purse.

    If the transaction was over 30 days ago, Paypal won't do a thing. That happened to me a few months ago so I disputed the charge with my credit card company. They removed the charge, sent me a form to fill out with the reason I disputed the charge and contacted Paypal about the chargeback (a separate, substantial charge imposed on retailers by the credit card company if a charge is disputed).

     

    Paypal sent me a nasty email saying I should have tried to resolve it through them and that they were considering suspending my account. I told them that they needed to check their records - I DID try, and they did nothing. I was in a seriously bitchy mood that day, so I told them that I would seek legal counsel because they were protecting fraudulent sellers in order to avoid paying the cost of chargebacks. Needless to say I got a much friendlier message from them a few days later saying that they had levied the cost of the chargeback against the seller and suspended their account.

     

    Paypal and eBay like to take the easy way out by imposing stupid rules that don't do a screwed-over buyer any good at all. Be sure to wait until they confirm that they won't do anything else to help you, then dispute the charge through your credit card company. Good luck! :)

  2. Wow, this is getting nasty. I've been reading this thread lately not out of personal involvement but out of professional interest - I'm a paralegal with 10+ years of experience in publishing and intellectual property law. I've never dealt with Kat or sspert so I'm not trying to stick my nose in here and take sides, but since I have some experience with this kind of stuff, there's something I wanted to point out.

     

    JLPRocks was absolutely right when he said that Kat has stated, in a public forum, that she's sold unauthorized CDR's of copyrighted material. That statement, along with any records that could be subpoenaed from eBay (if she did sell these on eBay) and/or any other electronic media (including email accounts), could be used as evidence in a civil action and could result in a monetary judgment in favor of the band's label and/or publishing company, if they were to bring a copyright infringment action against her. Just because a band's material was never officially released or currently commercially unavailable in no way means that their copyright is no longer intact - that's a no-brainer and should be common knowledge. Most copyrights are registered internationally as well as in the US, so a label or publisher could possibly file a lawsuit in a Canadian court.

     

    Like I said, I'm not taking sides here because I'm not personally involved and I don't have all the facts, but I wanted to point out the possible implications to EVERYONE, not just Kat. Given the current climate in the music business against piracy, we should all be careful about what we buy and sell and the statements we make about it. Even my offer to Rick could be construed as piracy - remember the old Napster?? You'd be surprised how many people anonymously read boards like this - for instance, there have been huge effects on stocks just because of what's posted on a message board (Yahoo Financials, for instance).

     

    It's just something to keep in mind when buying and selling. Sorry this was so long and I hope no one thinks that the newbie is trying to jump in here, but I just wanted to share what I know. Thanks. :)

  3. Hey Kat, it wasn't that long ago that you were selling Tuff Luck CDR's on ebay. Certainly NOT a year and a half. I emailed you questioning the listing and you responded that they were CDR's. I'm not involved in this soap opera in any way, buy I felt the need to expose that lie.

    Rick, I have the Tuff Luck CD - if you or anyone else would like a CDR of it AT NO CHARGE, please let me know. They were a great band out of South Florida and I was fortunate enough to see them a few times way back when (I'm originally from Miami). I'd be more than happy to share it! :drink:

    "Dirty Love" is one of my favorites!! Everytime I hear it that riff is stuck in my head for hours. :crazy: Another good "pissed-off" song is Skid Row's "Get the F*** Out" and L7's "Sh*tlist" -- "Bricks are Heavy" is a good pissed-off chick album! L7 is a bit out of genre for this site but it's still a cool disc.

    Given all the above info, I'm glad I never bid sspert's auctions that I was watching! I guess some of his/her stuff was legit, but sure enough I'd get the one that wasn't. Can someone tell me some of the sellers on ebay (besides PJ, whom I've already discovered) that are trustworthy and reputable? Thanks! :D

  6. I was just reading through all these posts and wanted to offer some info...

     

    Unfortunately, Ebay's "Fair Trade" and Paypal's dispute process are pretty much useless. I've had problems with auctions before and neither process even came close to solving the problem. If the other side doesn't want to cooperate, you're out of luck.

     

    The only way I was able to get my money back was to dispute the charge with my credit card company. Paypal will send you a pissy e-mail about it, saying you should have gone through them, but just ignore it. They eventually make the seller eat the cost of the chargeback. Good luck!

    Flea markets are great for out-of-print CD's. They're dirt cheap and you never know what you'll find!
