I've had all sorts of threats from people over the years to take down bad reviews or comments about their albums, the band, etc. It's all fuster and bluster and then they threaten to sue me, etc. They figure they can intimidate me into removing material that they don't like. Mark Alger tried at length to get me to take down the Z Records page, first by threatening me, then by trying to bribe me with promo releases (which he never did send me). If a bona fide law firm makes a proper formal request in writing I will take it seriously, but otherwise it's all just B.S. -Dan Dan I guess we will see how it all plays out. Paypal did the reversal and it was not due to a claim made by me. but you knowing all i can see how you would turn it all around, which is fine. I asked for info from you, i will wait and see if i receive it.

Just to clarify a couple of things. First off i am not here to argue or get into a confrontation. As Dan stated I have been speaking with Dan and have let him know everything that is going on. Once everything is done which i will know the exact day late friday after my meeting with the bank. Once that is done everyone will be refunded in full. Now I am going address what Adriano is saying. I did tell Adriano that if he continued to threaten me he would be the last one refunded. Now the reason being, I am getting daily emails from him with constant threats etc. Then I receive emails from him saying "he should be refunded first". I told him repeatedly the person affected the most with the biggest loss would be refunded first. He didn't like that answer, he then wants to be told the exact day, and i can understand that. I gave him the same info i have given Dan. It still was not good enough for him. He keeps saying if this is not done by such and such date he is going to do this and do that. Frankly i am sick of it. So i told Adriano if he can not speak to me in a cilvilized tone i would not answer anymore of his emails or messages, he continued with the same thing over and over, so i did just that. The refunds are not going to be done the way Adriano wants them, or the order he wants them. There is alot more but i am leaving it at that. As i said i am not here posting for a confrontation or to stir shit up. But this needed to be addressed and that is exactly what i am doing. With that said, that is the end of it. That's an excellent start. I do want to ask though, what is your timeframe and/or plan regarding those who are out large sums, specifically Adriano, Georg, and Music-Buy-Mail? Thanks, -Dan Dan To answer your question, I just returned from the bank where I am in the process of securing a loan to Take care of Sebastian and Georg. As far as Adriano is concerned and i am not gettig into an argument or any kind of shouting match with him. His cd's were mailed to him. But i am going to refund his money and he can return the cd's to me. As i have said i am doing all i can, and once i get everything taken care of at the bank, everyone will be refunded. I will continue to keep doing things the way i have been as i can till i get the loan situated. As i have said before i sincerely apologize to everyone who was hurt, i did not set out to intentionally scam or hurt anyone. Once everything is all done i will explain everything from start to finish and then maybe everyone will understand and see exactly what went on. I made some bad mistakes and i take full responibility for them, and am not looking for everyone to embrace me here as once it is all done i probably will not be back, but that is my decision. I just want everyone who was hurt taken care of and it all to be over and done.

I am only here to make a statement. And then i will not be back. I am doing all i can to make sure everyone gets their money back. Why would i want to come here and say anything, all some (not all people here) people are going to do is make up their own little theories and spew their bullshit like they have done so far. There are some good people here, no doubt. But what astonishes me beyond belief are the ones who have nothing to do with this at all want to talk so much shit. Stormspell, you can't say a damn thing because you have no clue, but like you do always you want to chime in. Same with Jarred, now you were involved and you will see your money back, but you like to make all your comments like you are a saint. How about when you called threatening a 65 year old woman, you can deny that, because i know you will, but it was recorded with your phone number, but that is not here nor there, shows just how big a man you really are. There has been more than 2 refunds, but only 2 people have commented here, did you people ever stop to think maybe some people don't live for the bullshit that most here stir up. I have all the proof in the world to show i am not the one who did all of this. Do i owe anyone here and explanation, especially after what has been said, without anyone trying to contact me personally to find out the whole story......NO. jim, i don't care if you believe anything or not. Adriano's cd's were shipped to him. Everyone wanted the whole story, now they have it. All i can do is try to make things right and straighten them out the best i can. I did not explain everything that has happened for your approval. Everyone wants a reply as to what is going on, and you all rightly deserve one as do I. I am not here looking for pity, but as has been said a few times already I myself have been on the scam end too. I don't expect to be forgiven but I was not behind this scam and maintain my innocence and promise each and every one on my son's life that. People do alot of rash things in panic situations. This all started in June of last year when i first started talking with the guys in Frontrunner. I was introduced to a couple of guys Ryaan and Ricky Ramierez from Memphis who owned a rather large promotion company. The more we talked the more I was led to believe they could help me further along this big dream i had. They were the money men and could help push things along. While we were meeting in memphis they came up with the idea of reissuing one of their favorite bands Hurricane. I was all for it, so within the next couple of weeks they tell me they are heading to Las Vegas to meet with Kelly Hansen after a show with Foreigner. When they returned they talked it all up, and told me of how great things went etc. Next thing i know they are off to Cali for what was believed to be more meetings. When they returned this time, they tell me that things went great and they got licensed agreements and signed contracts. When i asked to see these, i was given excuse after excuse, the lawyers had them, or they were in between places etc. It did throw up red flags, but my thoughts were, they have no reason to lie to me, damn was i wrong. I went into the whole label thing blind and was told by countless people i needed to be careful because people would use you and lie to you. I didn't listen. They visit HH and knew i was a good member here with alot of friends, so they came up with the deal of the preorder. They told me they didn't have a paypal account and it would be an easy way to track the orders etc. I asked about getting a formal website made, and i was told over and over it was in the works, but that to get the ball going , why didn't i just set one up and once they were done with the "official" website we could just move everything. So that is what i did. At never at any point did i set out to deceive anyone or scam anyone. Contrary to what everyone here may think. then the deal with Georg came about. I called Ryaan and told them we had a big order, they told me to come to memphis and they would get it taken care of. When i arrived down there they had it boxed, I returned home and sent it ups as promised. there was a problem, but it was not my doing. I took it to the UPS hub, i never thought to pay attention to the waybill. Actually there are 2 copies, one is signed, one is not. But after the problem, i called them back, told them of the screwup and was told to come back down and they would take care of it. I never opened or looked in the box, so i do not know what was in it. It is actually still at the hub and i will find out tomorrow. But i can tell you it is not any kind of reissued cd's. I called the so called pressing plant in memphis today and was told they have done no work, for either Ramierez and if i was smart i would steer clear of them myself. Of course that made me even more sick to my stomach. So i called their office, and lo and behold the number had been disconnected. So i then tried the cell numbers i had, and those too had been changed. So it really all began to sink in. As far as the other titles that were listed, the same thing, i was told something and without seeing the legalities with my own eyes, i listened to others and got burned. As far as everyone's money goes, i never took any of the money from the paypal account. they had all the passwords etc, i agreed to let them pull the funds to take care of expenses and costs, and i would receive payment once all of that was taken care of. Well guess what i have not seen a dime. After speaking with Phil Carson (Kelly Hansens representation) he and i both agreed the best thing to do was refund the money and put all of this behind us. Which is exactly what i am doing. I have already refunded some and will have the rest done refunded before the week is done. Everyone will get their money back, i promise you all that. I know my word doesn't mean a damn thing to anyone here and it shouldn't, but i didn't hatch a scheme or scam and sure as hell did not plan it out over a long period of time like some would suggest. I have seen several posts asking why i have not come forward and made a statement, well to be perfectly honest, there are several reasons. 1-shame that all this has happened to alot of people i called friends. 2-i didn't want to see all the scenarios that all the "slueths" here like to put up, who actually do not know anything about what is actually going on. 3- i made the situation worse when i paniked because i too was at a loss for what was going on, so i had to find a way to see if i could find out what had happened. Lying was not good as it hurt alot of very good friends. I have mad alot of mistakes and i do not expect to be forgiven like i said earlier, but i am being 100% honest, no more bullshit, this is on the level. As far as David goes, he is my nephew and he was trying to help, which only made things alot worse, and for that i apologize. I am truly sorry for everything and if i could go back and change it i would. Once all the refunds are made, you won't ever see me here again. But that is the whole story. All i ask is for the ones who are making the threatening phone calls to stop, as the calls are being recorded now. If i was truly the guilty party i sure as hell wouldn't be refunding money, especially after i have not seen a dime to begin with. So with that everyone can make up their own little stories or scenarios and plots etc......I have had all of this i can take, it has weighed very heavy on me as well it should have, because i should have been alot smarter and pushed harder to see all the "legal documents" and then none of this would have happened. Hi Everyone David here. First I would like to thank everyone for the well wishes, they mean alot to me and my family, and I know Lonnie will feel the same once he knows exactly what is going on. I just spoke with my grandmother about 45 minutes ago. They have Lonnie heavily sedated. He is on a ventilator right now and is being monitored very closely. He is in the UCU(Upgraded Care Unit). I have misplaced the address here on my desk and I will email it to each and every one of you just as soon I find where i sit it at. Everything here is a madhouse. But to update everyone on the Hurricane cd's. I am awaiting a phone call from Dreamworks(the company who has handled everything from remastering to pressing the cd's), I am just waiting for them to have the entire order filled which should be middle to late this week. Now I feel I need to address Mr. Georg Siegl. I sure as hell hope he reads this, because the slanderous statements are unfounded and honestly complete bullshit. Just for all of you to know this is how the deal has gone down. Georg wanted to order a very large amount of the Hurricane cd's. So Lonnie obliged him, and worked a deal where the overrun would be a couple of hundred extra. Georg wanted these sent via UPS, he would not take any other shipper. Granted he was giving his UPS account number so the freight would be on him. He was told upfront about the problems we have here in this small town with shipping internationally. But that is what he wanted. So there were 3 packages each weighing approx. 19lbs each, taken to the hub and shipped. Georg was emailed the tracking number and a copy of the Waybill. Well the next day, Georg says there is a problem, he couldn't track the package from his end. So we call UPS, the package made it as far as the Memphis UPS hub and disappeared. So Lonnie went to UPS and raised hell and filed a very large claim. Because in all honesty when we went to the hub, the people who took care of the package didn't have a clue what they were doing. Georg claims the Waybill was fake and not signed, well I beg to differ, because I have it right here in front of me, and it is signed and is not a fake(I didn't know you could fake one of them as it is all handwritten with 4 different copies). I will gladly supply anyone here with pictures of the Waybill, because we have nothing to hide. Lonnie is one of the most standup guys I know and I am not saying that because he is my uncle, and I know all of you that know him, know exactly what his character is made out of. But anyway, Lonnie made arrangements yet again, to take more cd's and re-send them to Georg, he didn't have to do that, he could have made him wait until UPS did their investigation. but no Lonnie wanted to be fair. So Georg was adamant that a UPS driver come and pick the package up, since there was a problem with the hub. Lonnie agreed and called in for a pickup, the first day UPS did not pick up due to the weather, Lonnie was told they would be there by 3pm on Thursday to pick it up the packages, UPS arrived and picked up the packages. They did not leave a copy of the Waybill, the reason being it had to be signed off on by a supervisor. Georg did not want to hear that, I guess he does not understand small town business, where everyone knows almost everybody and trust most of the time is not an issue. Well anyway the hub calls and they had canceled all pickups and deliveries yet again due to the weather, so Lonnie went to the hub to pick up the Waybill and to go to the post office to mail some other packages. the accident occurred sometime between the time he left at 2 and 3:15pm. I could easily blame Georg for Lonnie being out on the roads etc, but that is not right, Lonnie was trying to do business and make something good out of a bad situation that was caused by UPS. Had Georg listened and let Lonnie ship them another way other than UPS, this problem would of probably never happened. I have always heard Georg was a class act guy, but with him making accusations and threatening to slam this company over a problem he helped create with UPS, then I do not see why he is held in such high regard. He wants to accuse people of things, but he doesn't tell anyone how he tried to corner Lonnie on distribution rights in Europe, tell that story Georg, wait, tell the real version, not the one you are going to fabricate. I have contacted our attorney to see what kind of weight a lawsuit would carry, and apparently Georg with all his threatening and slander does not understand what can of worms he is opening. Honestly all that is not really important to me right now. It will be handled, what is important is Lonnie's health, and I hope none of you believe the garbage that is being told, as the whole story is above, I have emails and Waybills to prove this. I know Lonnie holds this forum and all of it's members in very high regard, and I know alot of you feel the same. Thank you for the support and I will keep everyone updated on Lonnie's condition. My post were just my thoughts and i am glad to see some agree with my thoughts on things or at least to some degree. I do want to say though and i should have put this in the other, I have no ill feelings towards anyone on HH whatsoever, and i hope no one took it as i was taking shots at any one person without naming them. Granted i know there are people who do not like Sam or the way he does business, and that is fine, it is not written anywhere that anyone has too. But it does piss me off that everytime a boot comes up on ebay, the same people automatically scream Sam's name, and honestly that is not fair. Like i said in my earlier post, at least he has the balls to say "yeah i sold a boot", but to say he and his label are behind all the boots, well that is complete and utter bullshit. He has obviously read your previous posts when you spaz out on people without much provocation (and threaten to kick them off ebay? Come on!). Please take a deep breath and look critically at your response. Things are tense for you now. Quick responses may not be in your best interest. Plus, I hope you are only kidding when you say you will give contact info out (other than what may be found on a website, etc.) FAKEPOLICE, I don't know who you are or where you are from, but the "most everything on Retrospect are Bootlegs" comment sounds awfully close to libel. If I were you, I would be VERY cautious about sweeping accusations like this. Any lawyers in the audience? Anyway, lest anyone think that I am shill for Sam or for anyone else, I want to re-state my thoughts from another thread: I have had successful business dealings with several people on this board, and I cannot stand it when they just shred each other in threads. It casts doubt on EVERYONE's character - No one comes away unscathed. In fact, I can think of 3 people right off the bat that I either am in regular contact with, or with whom I have had successful business dealings. Yet each of them has had p*ssing contests with Sam. This drives me up a wall. Oh, I have bought at least a hundred items off Sam over the past couple years, so it's not like I am unfamiar with his Retrospect items (take note, FAKEPOLICE). Between the other sellers on this board, I have bought several hundred additional items, as well. If this keeps up I may have to start a "Dear Abby"- like advice column just to deal with all the silliness! I guess what I am saying is this: This is a great board. To quote a great philosopher... "Why can't we all just get along?" TD Dude just to answer your philosophical (or however it is spelled) question as to "why we all can't get along?" ......I have sat back and even responded to a few of these threads about "Sam/his label/some of his buisness dealings"........Every few months something pops up and as always the finger pointing starts, and guess where all the fingers get pointed........exactly right at Sam.........I am not a Sam "mark" and don't find it my place to defend Sam, he is a grown man and can do that himself........But what really gets me is it is always the same people starting up the same shit. Sam has admitted he has sold some boots, damn nuff said.......But to go as far to say "everything on his label are boots" now that is going far, especially when most have no idea about how much work he has put into the cd's he has gotten out there.......But you never hear anyone saying "Thanks Sam for the killer music you are getting out there to the fans, that otherwise would never see the light of day, much less on cd"........ Sam and I have done alot of business over the last several months, he has bought probably in the neighborhhood of 1200 cd's from me, and i have never had to worry about being paid etc, he always does exactly what he tells me he is going too. Now if someone was as underhanded as alot of people have made him out to be, do you think he would ever follow thru with any business dealings he makes......I think not.......Everyone is so concerned about him selling a boot, i know there are alot of other sellers from this board who have sold boots, claiming them to be originals, just because they didn't know there were boots, or some may have known and just played it off. Hell some probably do not even know how to tell a boot from an original. In closing, I think people need to tend to their own business instead of trying to "police" everything Sam does......Be thankful for the music he is putting out, instead of trying to find things to stir up shit about. As I have said countless times, if you don't agree with his buisness dealings do not buy from him. People get pissed when he reacts the way he does (and sometimes i think he is a tad bit harsh and says some things he should think about before he says them) but when someone takes shots are your buisness, something you have worked very hard to make successful, it tends to piss you off, and everyone is going to respond in situations like that, maybe not to the extreme Sam does, but you are still going to react.........Lastly.....Like I said if you have a problem with how he runs his label and business, no one is twisting your arm to do business with him........He has always treated me very well, and I will continue to work and do business with him..........So there you have my thoughts on it all............. Ok i had to bite on this one......I bought a copy of the Robert Tepper, and yes it is definately a bootleg......the sound quality is not the greatest but not the worst, has some pops and hisses if you listen closely.....Also the artwork is not centered on the booklet, the printing on the cd itself is out of line as bad if not as worse as the Stage Dolls fiasco....It is silverpressed, which did shock me, but i only paid $10 for it.......Hell even the Rock It Records insignia is not straight.....hahaha......If you want it for just listening purposes it is cool, but if you are collecting steer clear.... I think the key thing here is, if you are selling to him, everything is great, it is when you try and buy from him is when everything goes to hell........Not sure i really understand that either.....

Damn he has some nerve complaining about shipping, i saw one of his auctions and he wants $10 for the 1st cd and $5 each additional........With Insurance and Registered being extra as well.......Total ripoff, i just bought 8 new japanese pressings direct from my regular Dist. in Japan, shipping was $25, but they were sealed in the jewel cases and were also sent EMS, he mailed them Sunday and they arrived today......But yes i will definately steer clear of Tomo.....
