I sent the following email to XYZ:

Good afternoon,

I run HeavyHarmonies.Com, a site devoted to 80s hard rock. One of the "hot

topics" on our message board is the legitimacy of CD releases coming from

Retrospect Records, owned by Sam McCaslin.

The following press release has been issued by the label:

"Hello!!  In response to the unauthorized bootleg released by Bobby Feiffer

(original guitarist for XYZ) , RETROSPECT RECORDS and XYZ officially

announce the new release by XYZ titled "Forbidden Demos - 1985-1990".  This

release features 18 previously unreleased tracks and rare demos from the

greatest decade ever!!  XYZ is EXCLUSIVELY represented by Retrospect

Records and we are excited to finally get these songs out to the world ,

the way they were meant to be heard.  Look for the new XYZ album Sept. 13 -

ONLY available from Retrospect!!  ROCK ON!  Thanks for your support!  Sam

McCaslin CEO-President Retrospect Records"

Is this release fully endorsed by the band? If so, are you aware that your

"reissues" will only be sold on Ebay by Mr. McCaslin, and not made

available through legitimate online vendors (NEH Records, AOR Heaven,

etc.). His practice thus far has been to make CD-R copies rather than

pressed discs, and sell them for $30-100 one at a time on Ebay, saying they

are "Limited edition of 100 copies" rather than flat-rate ($14-18) like

other labels do. I'm sure that makes Mr. McCaslin plenty of money at those

prices, but the availability to fans is severely curtailed at those price

points.

If you are fully aware of all of these aspects, and this is what you are

comfortable with, more power to you, and the best of luck on your release.

However, if the above is NOT the case, please let me know.

Thank you for your time,

-Dan Harding

Owner, Heavy Harmonies

While I did not receive any response from the band, I did receive the following from Sam:

HAHA - the owner of Heavy Hypocrites emails MY good friend Terry asking

whether the XYZ cd is legitimate!!!

HAHAH - YOU FUCKING MORON - Not only have I been Terry's friend for over 2

years but I have been musically active with the band for the same amount of

time....and you email Terry asking if I'm legit???

HEY DICKHEAD - Stick to your bullshit homo site and leave the REAL work to

the people who matter.  You and your ass bandit buddies will never get your

hands on MY OFFICIAL releases - SO FUCK OFF.  There's a new sheriff in town  ,

and he's kicking YOUR ass.

I see that Sam's the same personable, professional guy as ever... I'd be proud to have him representing my band.

Too funny...the last 2 times I've seen XYZ, there's been no Sammy boy. Sam, just because you played a tune with them on stage one time hardly makes you a member of the band <_<

Well..

I can say that I'm pretty sure Terry knows all about it. On more than one occasion I've seen Sam on stage playing keys for Terry. Once with XYZ and once with an All-Star Band with members from Badfinger, Rod Steward, King Cobra, among others. Wether or not people here believe it or not, Sam does have many connections. I would bet my whole CD collection that Terry is very aware of this release.

I could have posted here that I email Terry and he said "Yes... it is 100% legit". I'm not gonna argue about this again... I just stated that I know Terry and Sam are friends and Sam has played with Terry on occasions. Terry has hooked Sam up with many more connections... my opinion is that Sam wouldn't put this out if Terry didn't know. This going back and forth doesn't do any good anyhow. Every board regular knows of this debate and I'm sure not many are gonna change their minds either way. Everytime someone here trades CDRs they are in most cases doing the same thing they blame Sam for. I know most would say that they only have CDRs of OOP material... but I'm sure most have at least a few that are still in print. Again, if you don't wanna buy from Sam don't.

As I mentioned in my email, if XYZ (or any other artist for that matter) is fully aware of the manner in which their CDs will be sold, and they have no problems with that, then more power to both Sam and the artists... It makes no sense to me, but that's their prerogative.

That's not even close to the same thing and you know it. Dan, I said the same thing in my e-mail. I told Terry that if it is true, good luck and sorry for bothering you with it. Why would Sam get to release this stuff when XYZ could get some sort of record deal themselves or release it themselves? -_- I'm not buying it........just like Sam's cheapass bootlegs.

You totally missed the point LVKIX. If the bands are aware, then fine...we wouldn't have a problem with it....BUT!!!!!!!!!!...Are they totally aware of HOW he's releasing them is the question at hand and the point we're making here.

I'd be very willing to bet that if half the bands he says gave their permission, have no clue that he's only selling them on eBay one at a time. They also probaqbly have no clue thay they're being printed on cheap-ass CDR's and NOT in a legit Silver pressed fashion. They also probably have no idea that he has a God Complex and plans to keep the cd's out of the hands of people he has personal problems with.

It's probably their fault for not looking into it any further, but most would "assume" that when a supposed record company plans on "reissuing" a cd, they would do it legitimately through an online store, website, or through a retail store......NOT one at a time where they can control the amount it brings in by law of supply and demand. No matter which way you try to spin it, Sam is being shady as usual.

Way is Sam so bad at dealing with people and seems to get very upset and aggressive?? He jumps straight on the back foot as soon as you ask him any questions. It seems like he had got something to hide??

How can a owner of a record label handle himself in such an un-professionally manner and expect to run a viable business.

Maybe anger management could help him out??
